Help me . . . I’m FADING!

This post really hit a nerve with us.  What does the public really want to know or not want to know about you?

When I first started my real estate career, we had a sales meeting where our broker warned us to be careful about what we put on our Facebook page or in our blogs.  You do not want to offend a potential client!  I accepted his advice at the time and, so far, have been keeping my religious beliefs and most of my political leanings to myself!  BUT, it is getting more and more difficult as time goes on . . . when close friends invite me to support causes that I am passionate about, it is so hard not to join the fight!

 

The big question is SHOULD WE?  Should we whitewash ourselves because we are Realtors®?  When political discourse is forbidden for any portion of our society, democracy is weakened.  I have friends who disagree with my beliefs . . . heck, even my husband does much of the time!  Why would I  assume that potential clients would avoid me based on those same beliefs?  If this is the case, the whole avoidance technique is probably backfiring anyway.  If clients really are that concerned that we are just like them, then they are seeking out the agents who DO put themselves out there!

SHORT SALES, MARKET UPDATE 2010 TEMECULA

Often I have conversations with Realtors, family and friends that involve questions about short sales or uneducated statements about short sales.  Statements like "I wouldn't buy a short sale because they take too long and then never go through" to "I avoid the short sale listings because they're a waste of time".  For some the general consensus is that they aren't selling and that is the furthest thing from the truth.  Of course with a few keystrokes in the Realtor driven MRMLS I can get a very quick synopsis of the short sale market.

If you are wondering how the short sale market is shaping up in the City of Temecula, here are some numbers to wow you. 

These numbers represent Temecula addresses (including unincorporated custom home areas) from January 1, 2010 to approximately July 31, 2010

487 Closed Sales

Ranging in price from $70,000 - $ 1,122,784

178 Sales Pending

(Presumably with bank approval)

228 Sales Accepting Back up Offers

(Presumably waiting on bank approval)

Some quick math tells me that there are nearly 900 short sales that have successfully closed and/or are in process right now since the first of the year.  That's in sharp contrast to the 467 bank owned sales that are in process or have taken place in the same period of time.  And believe it or not there are still folks out there with some equity...we've had 389 standard sales so far this year as well.

There IS a New Real Estate Transfer Tax in the ObamaCare Law

This is a great blog from Lane Bailey.

It is a quite frustrating situation isn't it...unless of course you never intend to  make more than $200k a year (and that is just what the government has decided for now is too much to not be punished for). 

I wonder how many people are employed by those that make more than $200k a year?

One of the forums in which I participate has had stories on both sides of this issue for a couple of months… with the more conservative members saying that there is a 3.8% sales tax on the sale of homes, and those that are more supportive of the President and his policies saying that there isn’t.

Neither side was real specific about their information source… talk radio for some, blogs for others… nobody seemed to be going to the source… the 20,000+ page law signed by the President.  In all fairness, there is a LOT of room in 20,000 pages to hide a lot of little Easter Eggs like this.  And being fair to the other side, if there isn’t a tax, the bill isn’t going to say “there is not a tax” anywhere…

I have an answer…

There is indeed a tax on the sale of real estate.  It doesn’t apply to many people, but it WILL apply to some people that have profit from the sale of their homes. Starting in 2013, those with incomes over $200,000 will have to pay a 3.8% tax on profit from the sale of their primary residence or investment properties.  The exact amount will be based on a formula that includes the profit from the property and the income above $200,000.  The tax is not an income tax, but rather it is a “payroll tax”… officially it is a Medicare Tax.

It does not just apply to real estate, but also applies to investment income and dividends.

The bottom line is that both groups are right… and both are wrong.

But…

It will drive another nail into the luxury real estate market.  It has been in the doldrums for a while.  Adding new taxes will not get it going again.  And if you are thinking that this only affects ‘the wealthy’, think again.  Those homes are not built by ‘the wealthy’.  Those homes are not renovated by ‘the wealthy’.  Those consumers are more likely to hire contractors to do improvements.  And they are more likely to update more often…  They are a driver in the housing sector.  This added tax is NOT putting gas in the tank…

New Scam aimed directly at Realtors. Don't get bit.

Gene has posted a great blog about a current scam going on.  We get these emails all of the time especially off of our international ads.  Agents Beware!

This is a variation of the Craigslist scam and the Nigerian bank fraud. I sincerely hope no real estate professional has fallen for this grift ut since NAR is publicizing it - it's probably bit a few folks.

NAR Legal Affairs has learned of a new scheme designed to trick unwary real estate professionals

NAR Legal Affairs has learned of a new scheme designed to trick unwary real estate professionals into forwarding money to the scheme operators. The scheme works in the following manner: 

  • Salesperson receives an inquiry via email from an individual who identifies himself (no known female aliases yet) as a wealthy individual seeking a residential property. The individual lives outside the market area, and usually outside of the country. The individual operates under a variety of aliases, and also varies his housing requirements. Sometimes he is married with children, sometimes he is single.
  • The emails are written in a choppy fashion with incorrect grammar usage, suggesting English is not the writer’s first language. The emails also rarely contain any information relevant to the market in which he is seeking a home and are written in a generic style.
  • The individual claims to hold an important position at an existing business, although no one with the individual’s name actually is listed as working for the business.

If the real estate professional responds to the inquiry and sends the individual listing information, the following actions take place:

  • The alleged buyer selects the most expensive property from the listings that he receives and instructs the real estate professional to submit an offer for the property, stating that he will visit the property in the near future. 
  • He represents that the transaction will be an all cash transaction, and no title company should be involved. 
  • He requests the information that he needs to write on the deposit check, and states that the check will be sent either to the real estate brokerage or to an attorney. 
  • He will also send a forged bank (or brokerage) statement, showing significant assets, in addition to a copy of a forged ID.

If the Salesperson provides this information, the real estate professional (or attorney) will receive a check larger than the deposit amount. The reason for the higher amount will be attributed to something like needing funds for furnishing the new home. If the check is cashed, the alleged buyer will immediately withdraw the overage amount. The real estate professional’s bank will present the initial check for payment, and will then be told it is forged. Therefore, the real estate professional will lose the overage amount taken by the individual, as the trail of money is usually untraceable once it is withdrawn from the brokerage’s escrow account.

If you receive this email, you should ignore it and forward it to your local FBI office- SCAM@ic.fbi.gov

Empty Flyer Boxes Everywhere

Is it just me or does the sight of an empty flyer box on a For Sale Sign make you crazy?

In Temecula Wine Country I pass 7 For Sale signs on my drive into town, 6 of the boxes have been empty Forever.

For some reason I take it personal.  These are my peers.  My profession.   

1 of the listings has flyers nearly every day.  I'm impressed by that agent.

And really, this should not have that kind of impact.

There is the option to leave it off the sign completely and then the Potential Buyer has to call you.

Okay, I get that.  I totally get that.  It's called a strategy.

But what I don't get is the strategy of the empty flyer box.

Nope.  Can't even come up with one.  Not one.

So if you are going to go through the trouble of putting one on there.  Fill it.

Oh yeah and check it once in awhile....in case you need to fill it again.

If you are a Seller....don't you feel anxious when you run out of flyers?

If you are a Buyer....aren't you exasperated by the empty box?

If you are an Agent....why do you or don't you use a flyer box on your For Sale signs?

Myths & Truths of the Open House

Let's face it...a lot of Agents don't do them anymore.  They can be dangerous.  They can invite in trouble and they can be a waste of precious weekend time.  An in depth discussion with your Agent can determine if they are right for you and your family.

 

However, over the course of 12 years we've discovered the following:

Myth & Truth #1:  Neighbors are going to be in my house, nosing around.  And while initially this is true, they are also the voice of your community and since homes do sell often times to friends of friends in your neighborhood....why the heck not let them nose around?  Haven't you known someone that has been interested in living where you do?  Anything that may instigate a "showing" on your home is one step closer to a sale. 

Myth & Truth #2:  A real buyer would be pre-approved and looking with their Realtor this weekend and my home would get shown to them anyway.  True again and yet not everyone does the home buying thing in the right order.  Pre-approval first and so on and so forth.  Or maybe their Realtor is not available today and they are out just driving around.  Maybe they don't even know what they want yet and since home buying is "an emotional purchase" most of the time...well you just never know what can be accomplished when folks see the right house. 

And with all of the internet marketing available...homes are deleted from showing lists often due to misconceptions about the home based on photos or lack of information.  (Example later)

Myth & Truth #3:  Nothing ever comes of it.  Well I would beg to differ.  On our latest listing alone, 2 qualified showings resulted from open houses because the Realtors stopped by the open house and decided that the home in fact did match the criteria of the Buyer or...yep you guessed it...they had ruled the home out based on a misconception of the usability of the lot.

Myth & Truth #4:  My agent just wants to do an open house to get more business.  This may be the truest statement of all and yet it doesn't negate in any way the desire and goal to sell your home in the process.  And if number 1, 2 and 3 above hold true than isn't it worth it?

Quote from our latest open house "Well, I saw the pictures of this house when my Agent sent it to me but I thought it was somewhere else and further away from town than this and had ruled it out."  Hmmm.
